TERMS AND CONDITIONS

1. INTRODUCTION

These Terms and Conditions (“Terms”) govern the relationship between you, as a user, and Activ Sports App (referred to as “Activ Sports”, “we”, “us”, or “our”) regarding your use of our mobile application, "Activ Sports App" (the “App”), and any related services, features, content, or applications (collectively, the “Services”). Our aim is to provide a platform that helps people stay active by easily connecting them for local sports games.

Please read these Terms carefully before using the App or any of our Services. By accessing or using the App or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our App or Services.

Activ Sports is a sports matchmaking platform designed to facilitate the organization of sports games at local facilities. Our Services enable users to find, join, and organize games such as football, basketball, and other sports, connect with other players, and stay active (the “Platform Purpose”). More details about the features and functionality of our Services are available within the App.

We reserve the right to modify these Terms at any time. We will notify you of any changes through the App or other reasonable means. Your continued use of the App or Services after such notification constitutes your acceptance of the revised Terms.

2. USER PROFILES

To use our Services, you may need to create a user profile. You agree to provide accurate and complete information when creating your profile. Your profile may display your name, photo, preferred sports, and self-assessed skill levels.

Users can rate each other based on their sports skills after each game. These ratings contribute to a user's statistics, which may include games played, average ratings, and sports played. You are responsible for the interactions you have with other users on the Platform.

3. GAME SESSIONS

Users can create game sessions by providing details such as the sport, facility name, date and time of the game, maximum number of players, required skill level, and a game description. You are responsible for the accuracy of the information you provide when creating a game session.

The App allows users to search for available games based on sport, location, date/time, and skill level. Game listings will display key information such as the sport name, facility location, date and time, player count, and skill level indicator.

4. JOINING AND LEAVING GAMES

Users can join available games through a designated function in the App. You agree to only join games that match your skill level and availability. You may also be able to leave a game if your plans change, provided it is within the allowed timeframe as specified in the App.

The "Join" button will be disabled when a game reaches its maximum number of players to prevent overbooking.

5. USER CONDUCT

You agree to use the App and Services in a respectful and lawful manner. You shall not:
- Engage in any form of harassment, discrimination, or offensive behavior towards other users.
- Post or share any inappropriate, abusive, or illegal content.
- Attempt to impersonate another user or entity.
- Interfere with or disrupt the operation of the App or Services.
- Use the App for any commercial or unauthorized purposes.
We reserve the right to suspend or terminate your account if you violate these conduct guidelines.

6. DISCLAIMER OF WARRANTIES

The App and Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Activ Sports does not guarantee the availability of games, the suitability of other users, or the condition of the facilities listed. You acknowledge that your use of the App and participation in any games organized through the App is at your own risk.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Activ Sports shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your access to or use of, or your inability to access or use, the App or Services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, whether or not Activ Sports has been informed of the possibility of such damage.

8. INDEMNIFICATION

You agree to indemnify and hold Activ Sports and its affiliates, officers, employees, and agents harmless from any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the App and/or Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any right of privacy or intellectual property rights; (iv) your violation of any applicable law, rule, or regulation; (v) any content that is submitted via your account including without limitation misleading, false, or inaccurate information; or (vi) your willful misconduct.

9. TERMINATION

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will cease immediately.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Qatar, without regard to its conflict of law provisions.
